1. Definitions

• Platform/Website: This website or application and its associated services.
• Shopper/Personal Shopper: The person who provides a purchasing service to the customer based on their request, through a "Shopper" account on the Platform, or who offers products already purchased in advance for customers on the Platform.
• Customer: The person who requests services and products from a shopper through a "Customer" account on the Platform.
• User: Anyone who uses the Platform, whether a shopper or a customer.
• Purchasing Entity: The store, company, brand, seller, or manufacturer from which the shopper purchases the product they sell to the customer.
• Account: The personal profile registered under the user's name.
• Content: All text, images, data, files, and information published or made available through the Platform.
• Services: All current or future services provided through the Platform.

2. Legal Capacity

The user acknowledges that:

• They have reached the legal age, or are using the website with the consent of their legal guardian.
• They possess full legal capacity as recognized under Saudi law.
• All legal consequences arising from their use of the Platform apply to them personally, or to their guardian if they lack, or are deficient in, legal capacity.
• They bear all legal consequences and penalties prescribed by law if they enter incorrect or misleading personal data.

3. Account Creation

The user undertakes to:

• Provide accurate information upon registration.
• Keep login credentials confidential.
• Not share their account with others.
• Bear responsibility for all activity carried out through their account.

The website has the right to suspend or cancel any account that contains inaccurate data or is used improperly.

4. Use of the Website

The user is prohibited from:

• Violating the terms of this agreement or the regulations and instructions in force in the Kingdom of Saudi Arabia or abroad.
• Publishing any misleading, unlawful, or offensive content.
• Infringing intellectual property rights.
• Attempting to breach the website's systems.
• Using the website to harm others or disrupt the services.

5. Services and Fees

• Some services may be free or paid.
• The website reserves the right to modify fees or services, add new services, or discontinue existing ones at any time.
• The service is not guaranteed to be permanently available.
• Fees are paid through the means approved within the website.

6. Payment and Refund Policy

• All payment transactions are made exclusively through the approved electronic payment methods within the Platform.
• The user is not entitled to claim a refund of any amount paid after a purchase is completed, except in accordance with the exchange and return policy of the purchasing entity or shopper, or in cases the Platform determines after verifying the complaint and its circumstances.
• The Platform bears no responsibility for the rejection of an exchange or return request if that rejection results from the policy of the purchasing entity or shopper, unless the reason for rejection violates applicable regulations or these Terms.
• If a customer alleges a defect or fault in a product, or any other matter requiring a return or exchange, their right to a return or exchange lapses unless the request is submitted within twenty-four (24) hours of receiving the order.

7. Suspension or Holding of Disputed Funds

Where a dispute arises between a customer and a shopper, or where fraud or a breach of these Terms is suspected, the Platform has the right to temporarily suspend or hold the funds related to the disputed transaction until the investigation is completed, the complaint is resolved, or a settlement is reached between the parties. This is considered part of the Platform's regulatory authority and does not give rise to any liability or compensation owed to either party.

8. Intellectual Property

All intellectual property rights relating to the website belong to their owner, including trademarks, logos, designs, databases, software, and content published by the Platform. No part of it may be copied or reused without prior written consent.

9. User Content

Where the website allows users to upload content, the user acknowledges that:

• The content is owned by them, or they are licensed to display it and its information.
• The content does not infringe the rights of others.
• The content does not violate the provisions of Islamic Sharia or Saudi regulations.
• The Platform has the right to remove any content it deems warranting removal, for any reason it deems appropriate.

10. Disclaimer

Services are provided "as is" and "as available." The website makes no express or implied warranties regarding the continuity of the service, its being free of errors, or its conformity with the user's expectations.

11. Limitation of Liability

The website bears no liability for: technical failures; loss of data resulting from circumstances beyond its control; the acts of users or third parties; or any indirect or consequential losses.

12. Force Majeure and Emergency Circumstances

The Platform bears no liability for any delay, interruption, or disruption in providing its services if that results from force majeure or emergency circumstances beyond its control. This includes, without limitation: natural disasters, wars, government decisions, technical failures, disruption of telecommunications or internet networks, or any cause that cannot be foreseen or prevented.

13. Compensation and Penalties

The user acknowledges that they bear all legal consequences resulting from their violation or breach of the terms of this agreement, and from violating the regulations in force in the Kingdom of Saudi Arabia or abroad. This does not prejudice the Platform's right to claim compensation and take whatever action it deems appropriate, including suspending or cancelling the account, and claiming compensation for all damages and losses sustained by the Platform or by third parties.

14. Termination of Use

The website may, without prior notice, upon a violation: suspend the account, restrict access to the services, or permanently cancel the account.

15. Anti-Fraud and Suspicious Transactions

The Platform has the right to stop or refuse any transaction, or suspend any account, upon suspicion of fraud, money laundering, unlawful use of payment methods, or any violation of applicable regulations or these Terms. It also has the right to take the necessary legal measures and report to the competent authorities whenever required.

16. Amendments

The website may amend these Terms at any time, and the user's continued use of the website is considered acceptance of the amendments.

17. Governing Law and Jurisdiction

• These Terms are subject to the laws of the Kingdom of Saudi Arabia, and Saudi courts have exclusive jurisdiction over disputes arising from them, unless otherwise agreed.
• In resolving disputes, the Platform relies on the records, conversations, and data stored within it as the primary reference for proving dealings between the parties, without prejudice to the rulings of the competent judicial authorities.
• The Platform's management has the right to intervene as a mediator between the customer and the shopper.

Data Sharing

Personal data is not sold; however, the user grants the website the right to share it with: technical service providers, electronic payment providers, competent government authorities upon lawful request, and shipping companies.

Responsibility

I acknowledge and undertake the following:

• My full awareness that the Platform is merely a technical intermediary connecting me, as a customer, with the personal shopper, and that it bears no liability arising from the content or goods offered or sold through it.
• That I will provide accurate information and data, clearly specify the finest details to the shopper, and bear responsibility for any discrepancy in product specifications, provided that I did not state such specifications to the shopper clearly and explicitly beyond doubt.
• That payment shall be made only through the official electronic channels provided by the Platform.
• That the Platform has the right to close, cancel, or suspend my account without prior notice whenever it establishes, or suspects, a clear violation of these Terms.
• That the Platform and the shopper bear no responsibility for any manufacturing defect in the goods.
• That I will not deal with any shopper outside the Platform, and will not respond to any shopper who attempts to contact me outside the Platform.
• That I will report to the Platform any shopper who attempts to contact me outside the Platform.
• In resolving any dispute, the Platform relies on the records, conversations, and data stored within it as the primary reference for proving dealings between the parties, without prejudice to the rulings of the competent judicial authorities.
• To receive the shipment within the specified period.
• To bear customs fees or taxes, if any, when they are payable by the buyer.
• Not to misuse the right of exchange or return, or to submit malicious complaints.
• Not to use payment methods that I am not legally entitled to use.
